Posting of drivers and minimum wage
Since 2 February 2022, road transport drivers fall under specific posting rules set byDirective (EU) 2020/1057, part of the Mobility Package. While posted, a driver is owed the host country's remuneration, not only its minimum wage.
When a driver is posted
- Cabotage – domestic transport inside another country.
- Cross-trade – international transport between two countries, neither of which is the haulier's country of establishment.
When a driver is not posted
- Bilateral transport to or from the country of establishment, including one additional loading or unloading in each direction (or two on the return leg if there were none on the way out).
- Transit through a country without loading or unloading.
Haulier obligations
- A posting declaration must be submitted before the posting starts.
- The driver must carry a copy of the posting declaration and the tachograph records.
- On request, the authorities must receive within 8 weeks: consignment notes, tachograph records, employment contract, payslips, time sheets and proof of payment.
